A person who has been granted, or made an application for, leave to enter or remain before 9 July 2012 in one of the following categories will remain subject to the Immigration Rules in force as at 8 July 2012 until settlement (the grant of indefinite leave to remain) even where the application is granted on or after 9 July 2012:
•
person exercising rights of access to a child resident in the UK (see Part 7 of the Immigration Rules);
•
fiancé(e);
•
proposed civil partner;
•
spouse;
•
civil partner;
•
same sex partner;
•
unmarried partner;
•
child;
•
adult dependent relative;
•
post-flight family member of a person granted refugee leave or humanitarian protection in the UK; or
•
14 year long residence.

Your wife was granted a fiance visa before 9th July - if I'm understanding correctly. Why is she therefore being considered under the new rules? Needs clarifying urgently. Contact the press and your MP.
ReplyDeleteThanks for this Steve. I am going to call the UKBA tomorrow and our local MP. This certainly needs clarification and if it turns out that we have indeed been misinformed by the UKBA you have to wonder how many others have been put through unnecessary distress.
ReplyDeleteNo problem. You need to tell them that you got a fiancee visa before 9th July. this changes everything and the links make this very clear.
